Terms of Use

These terms are an agreement between you and Moderatio LLC, [address] ("we"), for the Moderatio app and moderatio.app (together, "Moderatio"). By creating an account you accept them. If you got the app from the App Store, Apple's Standard Licensed Application End User License Agreement also applies, and Apple is not responsible for Moderatio or these terms.

1. Who can use Moderatio. You must be an adult who can legally drink alcohol where you live: 18 or over, 20 or over in Thailand and Japan, 21 or over in the United States. Moderatio is for people who want to drink less without stopping. It isn't for people who need to stop drinking; if that's you, please use the help resources in the app or talk to a doctor.

2. Your account. You create your account in the app. Keep access to your email or Apple or Google account secure; anything done through your account is your responsibility. One person per account.

3. Free trial and Moderatio Plus. New accounts get 14 days of Moderatio with everything included, with no payment details asked. After that, logging tonight and your current week stay free, and Moderatio Plus unlocks the rest. Plus is a subscription sold by Apple or Google in the app, or by Paddle on moderatio.app, at the price shown before you buy. It renews automatically until you cancel. Cancel in your App Store or Google Play subscription settings, or through Paddle for purchases on moderatio.app; cancelling stops the next renewal and you keep Plus until the period ends. Refunds are handled by whoever sold you Plus, under their policies and your local law.

4. Your content. Your log, reasons and occasions belong to you. You give us permission to store and process them only to provide Moderatio to you, as described in the Privacy Policy. If you choose "Suggest it for everyone" for a drink you added, you let us use, edit and publish that drink's name and details in the shared drink list, without credit and without payment; please don't include anything personal in a suggestion.

5. The drink list. Drink names, sizes and strengths in the shared list are there to help you log, and may be wrong; check the label and edit the drink if they are. Brand names belong to their owners and are used only to identify drinks. We don't advertise or endorse any drink.

6. Not medical advice, and never for driving. Moderatio isn't a medical device and doesn't diagnose, treat, cure or prevent any condition. Standard drinks, calories, warnings and help suggestions are estimates and general information, not advice for you. The tipsy-meter is a rough guess from what you logged; it does not measure your blood alcohol, can be wrong in either direction, and must never be used to decide whether you can drive, ride, operate machinery, swim, work or do anything else that needs you sober. Don't drink and drive. If you're worried about your drinking or health, talk to a doctor.

7. Using Moderatio fairly. Don't misuse Moderatio: no attempts to access other people's data, overload or break the service, reverse-engineer it except where the law allows, scrape the drink list, or submit suggestions that are unlawful, offensive or not about a drink.

8. Our rights. Moderatio, its design, illustrations, name and code belong to us. We give you a personal, non-transferable licence to use it while your account is open and you follow these terms.

9. Changes and availability. We improve Moderatio and may change or remove features. We aim to keep it available but can't promise it will always be. If we make a change to these terms that matters, we'll tell you in the app at least 30 days ahead; if you don't agree, you can delete your account before it applies.

10. Liability. We provide Moderatio with reasonable care and skill. To the extent the law allows, we aren't liable for indirect or consequential loss, or for decisions you make based on the app's estimates, and our total liability to you is limited to the greater of what you paid us in the 12 months before the claim and US$50. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence or for fraud, or removes rights you have as a consumer. If you are in Australia: our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms affects them.

11. Ending. You can delete your account at any time in Me or at moderatio.app/delete-account. We may suspend or close an account that breaks these terms, after telling you why unless the law or safety prevents it. Deleting your account doesn't cancel a store subscription; cancel it with Apple, Google or Paddle.

12. Law and disputes. These terms are governed by the laws of the State of Wyoming, United States, except where the law of the country where you live gives you protections that can't be changed by agreement. Talk to us first at support@moderatio.app; most things can be fixed. If not, disputes go to the courts of Wyoming, unless your local law lets you bring them where you live.
